IMPORTANT: READ THIS LIABILITY WAIVER CAREFULLY BEFORE PROCEEDING WITH YOUR BIKE RENTAL.
By checking the box below and submitting this rental agreement form, you agree to the following terms. This agreement affects your legal rights, including your right to sue.
I understand that biking involves risks such as falls, collisions, mechanical failure, traffic, and weather hazards. By signing the liability waiver as part of the rental agreement with Bike Me, I voluntarily assume all risks associated with the use of rented bikes and equipment, including the risk of serious injury or death.
In consideration of being permitted to engage in a bike rental and use a bicycle and equipment from Bike Me, I, for myself and anyone entitled to act on my behalf, hereby release and hold harmless Powers Legacy Enterprises LLC, DBA Bike Me, its affiliates, officers, employees, agents, hotel partners, and contractors from any and all claims for injuries, damages, or losses, including negligence, arising from my use of the rental equipment, as outlined in the rental agreement.
I agree to indemnify and defend Bike Me and its partners against any claims, damages, or expenses (including, but not limited to attorney's fees) arising from my use of the bike rental equipment or any violation of this rental agreement, including the liability waiver.
I acknowledge that I have inspected the equipment for the bike rental and find it in good condition. I agree to return it in the same condition as outlined in the rental agreement. I accept financial responsibility for any loss or damage during the rental period, as specified in the liability waiver.
I agree to the terms outlined in the rental agreement, including: obeying all local traffic laws and hotel rules, not riding under the influence of alcohol or drugs, not allowing others to use the rented equipment, using a helmet if required by law or advised, and refraining from off-road or unsafe riding behavior. This acknowledgment also serves as a liability waiver.
I confirm that I am physically fit and capable of safely operating a bicycle as outlined in the bike rental liability waiver included in the rental agreement.
This bike rental agreement is governed by the laws of the state of Florida. If any portion of the liability waiver is found invalid, the remainder shall remain enforceable.
By checking the box and submitting below, you agree that: You have read and understood this liability waiver related to the bike rental; You are at least 18 years old (or a parent/guardian is signing on behalf of a minor); This electronic acknowledgment serves as the legal equivalent of a handwritten signature for the rental agreement.
